Public Comment Opposing National Popular Vote Interstate Compact Initiative Petition 2026-068

I write to urge the rejection of Initiative Petition 2026-068. The National Popular Vote Interstate Compact (NPVIC) violates the United States Constitution in several ways.
The Compact Clause (U.S. Const. art. I, § 10) makes clear that “no State shall…enter into any Agreement or Compact with another State.”
The NPVIC is an attempt to amend Article II and the Twelfth Amendment by means other than those laid out in Article V.
The equal protection clause of the Fourteenth Amendment requires votes to be counted fairly and equally. Differences in state election law make this impossible and implicate the concerns addressed by the Supreme Court in Bush v. Gore.
Initiative petition 2026-068 should be rejected, or, if not, Missourians should be informed through ballot language and title that the proposed amendment would violate the United States Constitution.
